Libertad condicional y Estado de Derecho: el desafío de aplicar correctamente el Decreto Ley N° 321
Una interpretación legal que tensiona los principios constitucionales
La libertad condicional en Chile, regulada por el Decreto Ley N° 321, constituye un instrumento jurídico destinado a favorecer la reinserción social de las personas privadas de libertad.

No se trata de una gracia ni de un perdón estatal, sino de un beneficio penitenciario sujeto a control judicial, criterios técnicos y requisitos legalmente establecidos.

En los últimos años, sin embargo, este régimen ha sido objeto de controversias judiciales derivadas de la aplicación retroactiva de reformas más gravosas, lo que ha generado inseguridad jurídica y cuestionamientos al principio de irretroactividad penal.
El principio de irretroactividad y su protección constitucional
La Constitución Política de la República, en su artículo 19 N° 3 inciso 7°, consagra el principio de irretroactividad de la ley penal más severa.
Este mandato constitucional se complementa con el artículo 9° de la Convención Americana sobre Derechos Humanos y el artículo 15 del Pacto Internacional de Derechos Civiles y Políticos, ambos integrados al bloque de constitucionalidad por el artículo 5° inciso 2° de la Carta Fundamental.
Desconocer este principio vulnera no solo la legalidad penal, sino también la seguridad jurídica y la confianza en el Estado de Derecho. La Corte Suprema, en jurisprudencia reiterada, ha señalado que ni Gendarmería de Chile ni las Comisiones de Libertad Condicional pueden aplicar criterios o requisitos posteriores al momento del delito o de la condena.
El precedente “Gómez Arrué” y la doctrina del máximo tribunal
Un caso emblemático es el fallo “Gómez Arrué Eduardo contra Gendarmería de Chile” (Rol 217906-2023, 21 de septiembre de 2023), donde la Corte Suprema declaró que la Ley N° 21.483 —que endureció las condiciones de acceso al beneficio— no puede aplicarse retroactivamente.
Hacerlo, sostuvo el tribunal, vulnera el debido proceso, el principio de legalidad penal y los derechos fundamentales de las personas condenadas.
Esta doctrina tiene un alcance vinculante para toda la administración del Estado. Su inobservancia implica desobediencia institucional y puede generar acciones constitucionales de amparo (art. 21 CPR), así como responsabilidad administrativa para los funcionarios que insistan en aplicar criterios contrarios a derecho.
La práctica actual: entre la reinserción y la arbitrariedad
Pese a la claridad de la jurisprudencia, en la práctica persisten errores en la aplicación del Decreto Ley N° 321, especialmente por parte de Gendarmería y las Comisiones de Libertad Condicional.
En mi experiencia profesional, he participado en más de 100 acciones constitucionales de amparo derivadas de la aplicación incorrecta de este régimen, lo que refleja una problemática persistente a nivel nacional.
Con la próxima ronda de entrevistas para la libertad condicional, surge una interrogante relevante:
¿Están los profesionales y comisiones evaluando los casos conforme a la ley vigente al momento del delito, o aplican las reformas posteriores sin distinción, agudizando la injusticia y generando una ola de recursos judiciales?
Una cuestión de legalidad, no de conveniencia
La libertad condicional debe analizarse desde un enfoque jurídico y técnico, considerando informes criminológicos y sociales objetivos, no bajo criterios coyunturales ni presiones mediáticas.
Solo así este beneficio cumple su propósito: preparar la reinserción social, reducir la reincidencia y fortalecer un sistema penal humano, acorde con el artículo 1° de la Constitución y el artículo 10 del Pacto Internacional de Derechos Civiles y Políticos.
El respeto al Derecho como garantía del sistema democrático
El respeto a la jurisprudencia de la Corte Suprema y a los principios constitucionales no es optativo: es una obligación jurídica y ética de toda autoridad pública.
Asegurar la coherencia en la aplicación del Decreto Ley N° 321 es fundamental para preservar la confianza ciudadana en la justicia y consolidar un Estado de Derecho robusto y predecible.
Más allá del delito y sus circunstancias, ninguna sanción penal puede imponerse violando los propios principios del Derecho Penal. Esa es la frontera que separa la justicia democrática del punitivismo arbitrario.
