Familia de una de las víctimas acusa omisión de auxilio y obstrucción a la investigación
La hija de uno de los fallecidos en la tragedia del río Pilmaiquén, ocurrida el pasado 19 de agosto en la comuna de Río Bueno, presentó una querella criminal ante el Juzgado de Garantía de Río Bueno.

La acción legal busca establecer responsabilidades por los delitos de homicidio simple con dolo eventual, omisión de auxilio y obstrucción a la investigación, centrando el relato de los hechos en la machi Millaray Huichalaf, quien dirigía la ceremonia mapuche que terminó con dos víctimas fatales.

Detalles de la querella y los hechos investigados
La querella fue interpuesta por Danitza Maripán Vidal, hija de Juan Ariel Maripán Paillán, una de las víctimas del trágico suceso. El abogado querellante, Ricardo Bravo Cornejo, confirmó que la acción judicial se dirige “en contra de todos quienes resulten responsables, ya sea en calidad de autores, cómplices o encubridores”.
Sin embargo, el relato presentado ante la justicia enfoca la responsabilidad principal en la machi Millaray Huichalaf, quien lideraba la ceremonia de sanación mapuche (lawen) que terminó en tragedia.
Según los antecedentes, los hechos se desarrollaron en la madrugada del 19 de agosto, en el sector del cementerio de Carimallín. Durante la ceremonia, Huichalaf habría indicado —tras un pewma o visión— que la paciente debía ser bañada en el río. Fue en ese momento cuando la mujer identificada como Mariana fue arrastrada por la corriente.
En un intento desesperado por rescatarla, Juan Ariel Maripán Paillán se lanzó al agua, siendo también arrastrado por la fuerza del caudal junto a otras personas. El cuerpo de Mariana fue hallado al mediodía del día siguiente.
Declaraciones del abogado querellante
El abogado Ricardo Bravo Cornejo expresó que “lamentablemente se realizó una ceremonia sin tomar las medidas necesarias de resguardo”.
Agregó que, tras el accidente, “la ceremonia continuó bajo la dirección de quien hoy es una de las principales imputadas, lo que generó que el padre de mi representada debiera lanzarse al agua para intentar salvar una vida”.
La querella también imputa el delito de obstrucción a la investigación, argumentando que la hija del fallecido habría sido víctima de presiones por parte del entorno cercano a la machi Huichalaf.
“Hubo presiones directas desde el círculo de la machi, más preocupados por la investigación que por el estado emocional de mi representada”, señaló Bravo, aclarando que estas presiones no provinieron de otras comunidades mapuche, las cuales han manifestado apoyo a la familia afectada.
Posibles responsabilidades de una empresa hidroeléctrica
El abogado también mencionó que se están evaluando posibles responsabilidades civiles de una empresa hidroeléctrica que opera en el sector del río Pilmaiquén.
Según indicó, “no se tomaron las medidas de seguridad adecuadas, no hubo señaléticas ni advertencias sobre la crecida del río por parte de la empresa”, lo que podría constituir negligencia concurrente.
Próximos pasos judiciales
La defensa de la familia se encuentra a la espera de que la Fiscalía formalice la investigación, destacando la buena disposición y transparencia mostrada hasta ahora por el Ministerio Público.
El caso abre un debate sobre la responsabilidad penal y cultural en contextos de ceremonias ancestrales, y cómo deben abordarse judicialmente cuando derivan en hechos trágicos que involucran tanto creencias tradicionales como posibles omisiones de seguridad.
