Divorcio en Chile: Guía Legal, Tipos y Procedimientos
Desde 2004, el divorcio en Chile es una vía legal para poner fin al matrimonio civil, regulado por la Ley de Matrimonio Civil. Este proceso permite disolver vínculos matrimoniales y regular los derechos y obligaciones entre cónyuges.
En 2022, el Poder Judicial registró 59.538 demandas de divorcio, evidenciando que, aunque es un trámite común, sigue conllevando carga emocional, económica y familiar.
¿Qué es el divorcio?
El divorcio es la disolución del contrato matrimonial, ejecutado a través de una demanda ante el Juzgado de Familia. Puede ser:
Por mutuo acuerdo, cuando ambos cónyuges consienten la separación.
Unilateral, cuando solo uno de los cónyuges solicita el divorcio tras cese de convivencia de al menos 3 años.
Culposo, cuando la ruptura se atribuye a la responsabilidad o culpa grave de uno de los cónyuges.
Régimen patrimonial en el divorcio
Los bienes y deudas matrimoniales se dividen según el régimen económico del matrimonio:

Sociedad conyugal: Los patrimonios se fusionan; la administración suele ser del marido, pero la esposa mantiene derecho a su patrimonio reservado.

Separación de bienes: Cada cónyuge administra sus propios bienes; no existe patrimonio común.

Participación en los gananciales: Cada cónyuge administra sus bienes, pero al término del matrimonio se reparte una compensación equitativa por utilidades.
Tipos de divorcio en Chile
Divorcio de mutuo acuerdo
Se realiza mediante solicitud conjunta y requiere un acuerdo completo y suficiente, regulando:
- Custodia y cuidado personal de hijos menores.
- Régimen de visitas (relación directa y regular – RDR).
- Pensión alimenticia.
- División de bienes comunes.
Divorcio unilateral
Solicitado por un solo cónyuge, demostrando cese de convivencia durante al menos tres años. Requiere demanda judicial y presentación de pruebas.
Divorcio culposo
Atribuye responsabilidad a uno de los cónyuges por:
- Infidelidad o abandono injustificado.
- Maltrato o violencia doméstica.
- Alcoholismo, adicciones o conductas ilícitas graves.
El divorcio culposo puede afectar derechos económicos y la custodia de hijos.
Requisitos legales para divorciarse
- Estar válidamente casados.
- Presentar la demanda ante tribunal competente.
- Residir en Chile o tener residencia legal o ciudadanía chilena.
- Para mutuo acuerdo: presentar acuerdo completo y suficiente.
Proceso de divorcio en Chile

Redacción del acuerdo completo y suficiente: Documento que regula custodia, pensión, visitas y bienes.

Firma ante notario: Validación formal del acuerdo.

Cese de convivencia
Elemento esencial para divorcio:
- Matrimonios previos a 2004: cualquier medio de prueba es válido.
- Matrimonios posteriores a 2004: debe registrarse en Registro Civil o ante notario, firmado por ambos cónyuges.
Compensación económica
Derecho de un cónyuge a retribución económica por haber reducido o abandonado actividad laboral para cuidar del hogar o hijos.
Se calcula según:
- Duración del matrimonio.
- Tiempo de inactividad laboral.
- Escenario económico de los cónyuges.
- Edad, profesión y estado de salud del beneficiario.
Efectos de la sentencia de divorcio
- Modifica el estado civil a divorciado.
- Elimina calidad de herederos entre cónyuges.
- Finaliza pensión alimenticia al cónyuge (si corresponde).
- Disuelve régimen de sociedad conyugal o participación en gananciales.
- Mantiene responsabilidad parental sobre hijos comunes.
