“La sentencia de la Corte Interamericana tensiona la legalidad y la seguridad jurídica del Estado”

Un fallo histórico con efectos sistémicos
El pasado jueves, el Pleno de la Corte Suprema de Chile celebró una audiencia pública sin precedentes, calificada por el propio Poder Judicial como “histórica”, al analizar los efectos del fallo de la CIDH en el caso Vega González y otros vs. Chile.
La resolución internacional ordena revisar la condena impuesta a Luis Osmán Yáñez Silva, condenado por delitos de lesa humanidad, lo que ha generado un intenso debate sobre la relación entre el ordenamiento jurídico interno y las obligaciones internacionales del Estado.
Bravo Cornejo plantea que el cumplimiento de esta sentencia “tensiona los pilares del Estado de derecho”, ya que no existe un mecanismo normativo que permita reabrir una sentencia ejecutoriada por mandato de un tribunal internacional.
“Cumplir con este fallo puede significar tensionar pilares del Estado de derecho y generar un precedente que erosione la seguridad jurídica en Chile”, sostiene el abogado defensor.
Consecuencias estructurales para el Estado de Derecho
—¿Cuáles son las principales consecuencias jurídicas de este fallo internacional?
La sentencia de la Corte Interamericana trasciende el caso individual y afecta la arquitectura institucional del Estado chileno. Implica que Chile debe revisar sentencias firmes dictadas bajo la ley vigente en su momento, lo que coloca en entredicho los principios de legalidad, cosa juzgada y seguridad jurídica.
Desde una perspectiva simbólica, el fallo refuerza el mandato internacional de sancionar violaciones graves a los derechos humanos, pero al mismo tiempo abre la puerta a reinterpretaciones retroactivas de normas penales, afectando la previsibilidad y estabilidad del sistema judicial.
Además, sienta un precedente regional de alto impacto, pues permite que cualquier sentencia nacional pueda ser revisada bajo nuevos estándares internacionales, incluso décadas después de haber quedado firme.
Problemáticas y riesgos institucionales
—¿Qué riesgos identifica usted como defensor frente a esta sentencia?
La principal preocupación radica en la afectación de la seguridad jurídica y la confianza en el sistema de justicia penal.
Reabrir condenas ejecutoriadas con el fin de agravar la situación jurídica de los condenados vulnera la cosa juzgada, el principio de legalidad y la prohibición de retroactividad penal gravosa (lex mitior).
Bravo advierte que la Corte IDH estaría actuando como una suerte de “cuarta instancia supranacional”, reexaminando no solo la legalidad sino también el fondo de las sentencias internas, lo que socava la autonomía judicial nacional.
Este fenómeno, sostiene, puede derivar en presión política sobre los jueces, debilitamiento institucional y una internacionalización excesiva del derecho penal chileno.
“La ausencia de procedimientos claros sobre cómo ejecutar estas sentencias genera incertidumbre, conflictos de competencia y un aumento de litigiosidad ante el Tribunal Constitucional”, advierte.
Dilema procesal: la ejecución de un fallo internacional
—¿Qué procedimiento corresponde aplicar para ejecutar una sentencia de esta naturaleza?
Desde un punto de vista estrictamente jurídico, Chile carece de un mecanismo expreso para ejecutar una sentencia de la CIDH que ordene revisar una condena firme.
Las normas nacionales solo contemplan la revisión de sentencias en casos excepcionales, como la aparición de hechos nuevos o pruebas falsas.
Cumplir con este tipo de fallos requeriría una innovación legislativa o una reinterpretación profunda del control de convencionalidad, lo que tensiona principios básicos como la irretroactividad penal y la supremacía constitucional.
“El Estado se ve forzado a buscar una fórmula inédita: o promulga una ley especial o redefine el alcance del control de convencionalidad. Ambas opciones generan un impacto estructural en la jerarquía normativa del país”, explica Bravo Cornejo.
Desafíos para el Estado y la institucionalidad chilena
—¿Qué consecuencias prácticas y políticas puede tener esta decisión?
Para Bravo, las implicancias van más allá del caso Yáñez Silva. La posibilidad de reabrir causas firmes erosiona la previsibilidad del derecho y debilita el valor de la cosa juzgada como garantía constitucional.
Asimismo, plantea el riesgo de una “internacionalización del derecho penal”, donde tribunales externos condicionen la interpretación de leyes nacionales y la determinación de penas.
“Chile enfrenta un dilema: cumplir con los compromisos internacionales sin desnaturalizar su orden jurídico interno. Esto exige un debate de Estado, no solo judicial”, concluye el abogado defensor.
